Marrying a spouse from abroad and bringing them to the USA

Many American Muslims marry someone from overseas. It is a big decision with legal steps. This is general information only. Immigration rules change, so use the official USCIS website or a licensed immigration attorney.

Know the two routes in outline

  • Fiancé(e) visa (K-1). A US citizen petitions for a fiancé(e) to enter the US and marry within a set period after arrival. The couple generally must have met in person within a set time before filing.
  • Spouse visa. A citizen or permanent resident petitions for a spouse the couple has already married.

Eligibility and process are set by USCIS and the State Department, and change from time to time. Check the official guidance.

The marriage must be valid

For immigration, the marriage generally needs to be legally valid where it took place. A nikah without the registration that country requires may not be enough. Make sure it is registered and you hold the official certificate.

Keep records

Applications look at whether the relationship is genuine. Keep photos, messages, travel records and evidence of family involvement.

Be careful

Watch for anyone who asks for money, rushes the marriage or avoids video calls. See how to spot fake profiles. Use a licensed attorney if you need help, and avoid anyone promising a guaranteed result. See the international Muslim marriage guide.
