Marriage guide

How to register a Muslim marriage in the UK.

Many British Muslims have a nikah without realising that, on its own, it may not count as a legal marriage. That can leave a spouse, usually the wife, without legal protection if the relationship ends or one partner dies. This guide explains the options for making your marriage legally valid. It is general information, not legal advice. Rules differ in England and Wales, Scotland and Northern Ireland and can change, so always check with your local register office and official government guidance.

Why registration matters

A nikah is a religious contract, and it is valid in the eyes of Islam when its conditions are met. In law, a marriage in the UK is generally valid only if it is carried out in a way the law recognises. A couple who have only a nikah may not be treated as married for things like inheritance, pensions, immigration, property and divorce. See is a nikah legally recognised? and nikah in the UK.

Option 1: a civil ceremony as well as a nikah

The simplest route is to have a civil marriage at a register office or approved venue, and a nikah, on the same day or separately. The civil ceremony gives legal protection and the nikah gives the religious contract. Many couples do both, and some hold the nikah first with the civil ceremony soon after.

Option 2: a nikah in a registered venue

Some mosques and Islamic centres are registered for marriages, which means a nikah held there can also be a legal marriage if the legal requirements are met, including the presence of an authorised person. Not every mosque is registered, so ask before you book. In Scotland, certain religious celebrants can conduct a legally valid marriage once the paperwork is in place. Check the rules for the part of the UK where you will marry.

Giving notice

Before a legal marriage, couples generally have to give notice at their local register office, usually in person, with identity documents and proof of address. There is a waiting period after notice, and different rules apply if one of you is from outside the UK. Ask your register office what they need, and allow plenty of time. Do not fix a wedding date until you know the notice rules.

Documents you may need

  • Passports or other identity documents for both of you.
  • Proof of address.
  • Proof that a previous marriage has ended, such as a decree absolute or death certificate, if either of you was married before.
  • Immigration documents, if either of you is not a British or Irish citizen.

Requirements vary, so check with your register office.

If you only had a nikah

If you are already living as a married couple on the strength of a nikah alone, you can usually still have a civil ceremony later. It is worth doing so, because it gives both of you legal protection. If a relationship has already ended, take legal advice. See khula and Islamic divorce in the UK and can a divorced Muslim woman remarry?

Protecting yourself in the nikah contract

Whatever route you choose, write down your mahr and any agreed conditions. See what is mahr? and the Islamic marriage contract. Women in particular should keep a signed copy of everything.

Frequently asked questions

Is a nikah legally valid in the UK?

On its own it often is not. A legally valid marriage generally needs to follow the formalities the law requires, such as a civil ceremony or a ceremony in a registered venue with an authorised person. Check with your register office.

Can I have a nikah and a civil marriage on different days?

Yes. Many couples do. The civil ceremony gives legal protection and the nikah the religious contract.

Do I need to give notice before marrying?

Generally yes. You usually give notice at your local register office, and there is a waiting period. Ask what documents they need.

What if my mosque is not registered?

You can still have the nikah there, but you would also need a civil ceremony for the marriage to be legally valid.

Does registering a marriage affect my nikah?

No. A civil marriage and a nikah can sit side by side. Keep your nikah contract and mahr arrangements in writing.
