The short answer
A nikah can be a legal marriage in the USA if it meets the state’s requirements. Marriage is regulated by each state, so there is no single national process. A nikah on its own, with no marriage licence and no authorised officiant, generally does not create a legal marriage.
What states generally require
- A marriage licence from the county or state, obtained before the ceremony. Some states have a short waiting period.
- An authorised officiant, which in most states includes clergy such as imams
- Witnesses, where the state requires them
- Returning the signed licence to the office so the marriage is recorded and you can order a certificate

If the nikah is not registered
