Is a Muslim marriage recognised in Australia?

A nikah is a valid religious marriage, but Australian law has its own rules for what counts as a legal marriage. Many couples are caught out by this, so it is worth understanding before the wedding. This is general information, not legal advice.

The short answer

A nikah on its own is generally not a legal marriage in Australia. A marriage is legally recognised when it is solemnised by an authorised marriage celebrant in line with the Marriage Act 1961 and the notice and witness requirements are met.

If your imam is also a registered, authorised celebrant, one ceremony can be both a nikah and a legal marriage. If not, couples either hold a separate civil ceremony or ask a celebrant to take part in the nikah.

What the law generally requires

  • A Notice of Intended Marriage lodged with an authorised celebrant, usually at least one month before the wedding
  • An authorised celebrant who conducts or oversees the ceremony
  • Two adult witnesses and the legal wording of the marriage
  • Both parties free to marry and of legal age

Check the current requirements with the Attorney-General’s Department or your celebrant, as details can change.

Ways to make your nikah legal

  • Choose a celebrant-imam. Ask whether your imam is an authorised celebrant.
  • Add a celebrant. Some couples have the nikah led by an imam and the legal paperwork completed by a celebrant at the same event.
  • Hold a short civil ceremony before or after the nikah.

See nikah in Australia for the full process.

Why it matters

If a marriage is not legally recognised, there can be less protection over property, finances and children if the relationship ends, and it can complicate immigration, Medicare and tax matters. Women in particular are encouraged by many scholars and community leaders to make sure the marriage is legally registered as well. Read about the nikah certificate and the Islamic marriage contract.

Frequently asked questions

Is a nikah legal in Australia?

Not on its own. It becomes a legal marriage when an authorised celebrant solemnises it and the legal requirements are met. Ask your imam if they are an authorised celebrant.

Do I need a marriage celebrant for a nikah?

For the marriage to be legally recognised, yes. The celebrant can be the imam, if they are authorised, or a separate celebrant.

How far ahead do I give notice?

A Notice of Intended Marriage generally needs to be lodged at least one month before the wedding. Check the current rules with your celebrant.

Does an unregistered nikah protect a wife?

It has religious force, but legal protection can be limited if it is not a legal marriage. Many couples register the marriage as well.
